The New Jersey Supreme Court heard arguments Tuesday concerning whether workers' compensation insurance carriers can be held liable when uninsured doctors they hire commit malpractice. In the case at issue, a widow sued her husband's workers' compensation carrier, alleging that an uninsured doctor working as an independent contractor for the carrier failed to spot a tumor while examining her husband. The widow's attorney argued the carrier should be held liable for its negligent hiring of the doctor.
