Judge: Insurer Must Defend Homeowner Who Was Sued After Son Murdered Neighbor

An insurance company must defend a homeowner who was sued for negligence after her son decapitated and dismembered a neighbor, a New York state judge has ruled. Metropolitan Property and Casualty Insurance had argued that the murder was not an "accident" and was not covered by the woman's umbrella policy. But Nassau Supreme Court Justice Randy Sue Marber concluded that, since the insured "obviously did not expect and could not foresee her son murdering [her neighbor], that act was in fact an 'accident' from her point of view."

Fitzpatrick and Milton Thurm, of counsel to Lewis Johs Avallone Aviles, write that the cases analyzing the application of the assault and battery and intentional and criminal act exclusions commonly included in homeowner's and commercial general liability policies are quite fact-sensitive and often seemingly irreconcilable. However, a review of recent decisions issued by our appellate courts is instructive in determining whether the exclusion will preclude coverage in a given situation.
