Judge's Instruction Is Held to Violate Right to Counsel

An error by a New York judge has resulted in a new trial for a man convicted of murdering a grocery store owner during a robbery. During the trial, the judge called for an overnight recess while the defendant was being cross-examined, then instructed the defendant not to discuss his testimony with his assigned counsel. Though no objection was made, an appellate panel found the restriction denied the defendant his right to counsel and that the mistake warranted a new trial in the interest of justice.
