In a battle between the leading sugar substitutes -- Equal and Splenda -- a federal judge has ruled a jury must decide whether Splenda's claim that the product is "made from sugar so it tastes like sugar" is misleading. In Merisant Co. v. McNeil Nutritionals, the judge rejected a defense argument that Splenda's claim is literally true.
