In light of the recent stock and accounting scandals, the U.S. Department of Labor and the courts are enforcing more strictly the provisions of ERISA that govern the creation and administration of employee stock ownership plans. As a result of this heightened scrutiny, ESOP fiduciaries must thoroughly understand and completely perform the ESOP duties which employees entrust to them, or risk becoming embroiled in costly and time-consuming litigation.
