California's Commission on Judicial Performance has initiated formal proceedings against a judge it says tried to use her position and that of her husband, a state appeals court justice, to avoid arrest for driving under the influence of alcohol. At the scene of her arrest, Judge Elaine Rushing allegedly said she had not been driving and had been sitting in the back seat, even though her Porsche sports car had no back seat. The complaint alleges that Rushing "repeatedly" told officers that she was a judge.
