Cooperatives and Condominiums

Richard Siegler, a partner at Stroock & Stroock & Lavan and an adjunct professor at New York Law School, and Eva Talel, also a partner at Stroock, write that increasingly, condominiums are acting like co-ops in order to obtain greater control over apartment transfers. However, without a court ruling on the lawfulness of these provisions, it is uncertain whether condominiums have crossed the line and enacted provisions which constitute unreasonable restraints on alienation.

Cooperatives and Condominiums

Richard Siegler, a partner at Stroock & Stroock & Lavan and an adjunct professor at New York Law School, and Eva Talel, a partner at Stroock and an adjunct professor at Cardozo Law School, review cases demonstrating that judicial deference continues to be given to co-op and condominium board decisions and challenges to the same summarily dismissed unless a shareholder or unit owner can demonstrate that a board acted in a manner that was not in the best interest of the co-op or condominium, outside the scope of its authority, or in bad faith.

Rising legal star takes plea bargain

Rising Miami legal star and community activist Richard Simring has quietly agreed to a plea deal in which he has pleaded guilty to conspiracy to commit mail fraud and money laundering in connection with his role as in-house counsel to an indicted billionaire businessman. Simring, a former partner at Stroock Stroock & Lavan and Jorden Burt, plead guilty in July in the Eastern District of Virginia and is facing possible suspension of his Florida Bar license. Simring took the plea deal, in which he faces a possible five years in prison and must testify against his former boss, before a grand jury could indict him, according to his lawyer.

'Levandusky' at 21: Board Protection Continues

In their Cooperatives and Condominiums column, Richard Siegler and Eva Talel of Stroock & Stroock & Lavan review recent decisions that illustrate courts' continued deference to co-op and condominium boards, unless the apartment owner establishes that the board acted in bad faith, without authority, or not in furtherance of the condominium's or co-op's legitimate interests.

Cooperatives and Condominiums

Richard Siegler and Eva Talel, partners at Stroock & Stroock & Lavan, ask: Who is responsible when a package addressed to a resident is accepted by a co-op or condominium building, but never reaches its intended recipient? Who is responsible when a resident places property in the building's storage area when it subsequently cannot be found?

Ethics and Criminal Practice

Joel Cohen, a partner at Stroock & Stroock & Lavan and adjunct professor of law at Fordham Law School, and Danielle Alfonzo Walsman, an associate at Stroock, write that although Judiciary Law §487 was dusted off in People v. Bergrin, it is hardly likely that every prosecutor across the region will open a "Major Lies Bureau" and prosecute each lawyer who appears to make false representations to a judge or party. Nor are judges likely to install polygraph sensors at each podium and counsel's table any time soon. However, the Bergrin case should underscore for every lawyer the seriousness of the issue and that there, in fact, exists no wiggle room on the matter.

Pro Bono at the Crossroads

Kevin J. Curnin, a partner and the director of Stroock & Stroock & Lavan's Public Service Project, writes: Today, the law's impact on how we live and die is omnipresent. Health care reform, climate control accords and market regulation are the dominant examples, but there are others, less dramatic but no less deeply impactful: housing, bankruptcy, benefits, immigration, disability. The imbalance between "the haves and the have-nots" is with us now more than ever. Pro bono lawyers, at least part of the time, align with the "have-nots," the uneducated, the marginalized, the unprotected.
