North Hempstead, N.Y., is pursuing a $36 million legal malpractice claim against Winston & Strawn, its former outside counsel. The suit accuses the firm of protecting its own interests at the expense of the town in a 1994 lawsuit that ended five years later with a $28 million verdict against the municipality. The complaint accuses the firm of "purposeful failure" to raise and pursue a valid defense on behalf of the town when it was sued by Sumitomo Bank of New York.

A New York appeals court has dismissed a $42 million malpractice claim brought by the town of North Hempstead, N.Y., against Winston & Strawn, likely ending a battle that ensued when the town was socked with a $32 million verdict after a failed waste transfer venture. The court found the Chicago-based firm could not be held liable for exercising its professional judgment and said the town had not supported charges that the firm had acted in its own self-interest because of an alleged conflict of interest.
