Sanctions in Trade Dress Case Leave Both Sides Unsatisfied

Neither side of a trade dress case is happy with a federal judge's order that a corporate plaintiff and its attorneys who acted with "dishonesty" and in "bad faith" pay the defendant companies roughly $379,000 in sanctions. Plaintiffs attorney Cary Ichter said the idea that mistakes by his side were purposely committed to deceive the court would be evidence of worse than bad faith, "because it is evidence that you're hideously stupid." The defendants' attorneys have claimed their client was shorted by more than $172,000.
