Rejecting an appeal by three law firms that demanded portions of the $55 million in attorney fees awarded in the $3.2 billion settlement of the Cendant Corp. securities litigation, the 3rd Circuit has ruled that the lawyers who were named to lead the case have the power to say who gets paid. According to the appeals court, the Private Securities Litigation Reform Act of 1995 established a "new paradigm" for securities litigation in which the lead plaintiffs and their lawyers call all the shots.

Judge Dismisses Class Against Mortgage Company

A nationwide consumer class action has been dismissed against GMAC Mortgage Group after a judge rules that the Real Estate Settlement Procedures Act does not prohibit mortgage brokers from "marking up" fees charged by third-party services providers unless there is evidence of an illegal kickback. The ruling is a victory for attorneys who argued that HUD's interpretation of the law was entitled to no deference because it conflicted with the plain meaning of an unambiguous statute.

The pension funds for New York City and New York State are fighting over control of a massive securities fraud litigation. The litigation, which will probably combine some 40 lawsuits, stems from April's 48 percent nosedive in the stock price of McKesson HBOC Inc., the nation's largest drug wholesaler. The state and city pension funds have filed competing motions to be named as lead plaintiff in the shareholder class action. At stake: Millions of dollars in fees for the winning pension funds' legal team.

A Philadelphia pension fund would rather quit its position as lead plaintiff in a stock-drop class action than dump a hometown law firm as counsel. In an unprecedented move in securities litigation, the Philadelphia Board of Pensions and Retirement told a federal judge in California that it no longer wanted to serve as lead plaintiff in a massive class action against Network Associates. The Santa Clara, Calif. software company was sued after it made bookkeeping errors that inflated its stock price.
