The New York Mercantile Exchange cannot enforce a copyright in the settlement prices it produces to value customers' open positions, a federal appeals court has ruled. In upholding a trial court ruling that found there was no infringement by a competing electronic exchange, the U.S. Court of Appeals for the Second Circuit said "enforcing the copyright here would effectively accord protection to the idea itself."
