States Move to Curb Nursing Home Suits
State legislatures are moving to cap damage awards in suits against nursing homes in an attempt to cut health care costs and tackle what they perceive as "runaway verdicts." In the past year, lawmakers in nearly a dozen states have introduced legislation to limit noneconomic damages in nursing home suits. Trial attorneys charge that the move to limit nursing home suits robs plaintiffs of their right to hold the facilities accountable.
Loss Causation in the Ninth Circuit
Barbara J. Hart, a shareholder at Lowey Dannenberg Cohen & Hart, and Todd S. Garber, an associate at the firm, write that the resolution of loss causation requires a fact-intensive inquiry unique to each fraud. Under the rationale applied in recent decisions, they note, plaintiffs appear to still be able to easily plead loss causation needing only to allege a plausible connection between the alleged disclosures and the drop in stock price, and such connection can have a significant temporal gap.

Partner Promotions Down a Third at Top 50 U.K. Law Firms
New partner promotions across the U.K.'s top 50 law firms plunged by a third between 2008 and 2009, with the downturn impacting lawyers' opportunities to make partner. Taking into account promotions at firms such as Clifford Chance and Simmons & Simmons, which pushed their decisions back until the summer, there were 399 promotions across the U.K.'s 50 biggest firms by revenue in 2009, compared with 598 in 2008.Trending Stories
