Nanotechnology: Firms Hope for Not-So-Small Miracle

In April 1998, lawyers at the Washington, D.C., office of Foley & Lardner landed the firm's first nanotechnology client &#150&#150 a division of the Eastman Kodak Co. called NanoSystems. Since then, Foley & Lardner and other firms have sought to establish themselves as the go-to firms for nanotechnology, science of building structures from molecular-sized particles measuring one-billionth of a meter. Lawyers predict the technology will rival the semiconductor, the Internet and biotechnology in significance.

Vaxiion Therapeutics, which develops new ways to deliver vaccines using genetically engineered mini-cells, claims Foley attorneys missed the deadline by four days, allowing a competitor to cash in on the same intellectual property, according to a complaint filed in San Diego County Superior Court. The kicker is that Foley allegedly represented the competitor at the same time.
