United States v. Harris et al

The Supreme Court's holding in Blakely v. Washington, that any aggravating sentencing factor, other than a prior conviction, which increases a sentence beyond the base offense range must be proved to a jury beyond a reasonable doubt, does not require that the sentencing factors must be charged in the indictment; however, defendants must be provided with due notice of the sentencing factors to prevent prejudicial surprise at trial, and such notice was provided here.
