Mercury Interactive to Cooperate With Lerach in Backdating Dispute

As Mercury Interactive contemplates suing former officers linked with options backdating, the company has sent clear signals it won't step on plaintiffs lawyer William Lerach's toes. Teaming up with Lerach in a civil derivative claim would be an unusual move in what is typically an adversarial process, but a source said it looked like an economic decision for Mercury to allow Lerach to pursue the derivative suit at his own cost while the company itself pursued the wealthiest of the four former officers.
