California High Court Rejects Comparative Bad Faith Defense

A liability insurer cannot assert the comparative bad faith of its insured as an affirmative defense in a bad faith action brought against it, the California Supreme Court held. Toy manufacturer Kransco was hit with $10 million in punitive damages after its primary insurer failed to settle a product liability action arising from a "Slip 'n Slide" for $750,000. Its insurer is now on the hook to pay the bill.
