The year 2001 was a big one for Texas plaintiffs' attorney Mikal C. Watts. In trials covering a wide variety of claims, Watts won nearly $100 million in judgments, including $43 million in this first plaintiff's victory in a case involving the diabetes medication Rezulin. However, had it not been for an 11th-hour settlement while the Corpus Christi, Texas, jury in the Rezulin case was deliberating punitives, the total would have been $100 million more.

Texas Hiring Shows Healthy Lateral Market

Lateral recruiting is a courtship, whether it starts with a casual comment at a pub or a whisper from a recruiting firm. Lateral hiring at Texas law firms increased in 2005, while the attrition rate held steady. Eighteen of the largest firms hired 463 laterals. Insurance Doesn't Cover Punitives for Wrongful Death

The Texas Supreme Court ruled in February that public policy does not prohibit insurance coverage of punitive damages, but it left the door open for a different analysis in "extreme circumstances." Now the 5th Circuit has concluded that such circumstances existed when a woman died from chemical burns. David Pruessner says the ruling could encourage insurers to contest coverage in more punitive-damages cases.
