Auto Paint Antitrust Suit Nets $105 Million

The final two defendants in a class action antitrust suit against the top manufacturers of automotive refinishing paint have agreed to pay $39 million to settle claims that they participated in a price-fixing conspiracy, bringing the total recovery in the case to more than $105 million. U.S. District Judge R. Barclay Surrick granted preliminary approval of the two settlements -- $16 million from Sherwin-Williams Co. and $23 million from PPG Industries -- clearing the way for notices to be sent to the class.

Southern District of New York Judge Denise Cote granted preliminary approval Monday to a civil settlement between former WorldCom CEO Bernard Ebbers, the U.S. Department of Justice and class action plaintiffs in which Ebbers will pay $5 million upfront and forfeit several business holdings and personal assets estimated to be valued between $25 to $40 million.
