Arnoff, a practitioner in New York City, writes: Breach of fiduciary duty and legal malpractice are causes of action that often mirror one another in the pleadings and either or both are predictably dismissed from the case. While these causes of action are often seemingly identical, they can and should be different, each with significant consequences and certainly should not be subject to dismissal when they are in fact not duplicative. Each can serve the public interest, not allowing the legal profession to fall below the requisite standard of professional competence but, more significantly, motivating the profession to rise to the highest standards of professional competence and ethics.

The lead plaintiffs firm that obtained a $624 million shareholder settlement against Countrywide Financial Corp. and KPMG LLP -- the largest recovery to date in a securities class action filed over the housing crisis -- is seeking more than $55 million in attorney fees and expenses. Labaton Sucharow, the New York firm hired by several New York pension funds on a contingency basis to pursue securities fraud claims against Countrywide and its senior managers, will argue for the fees during a Nov. 15 hearing.

Split verdict on women partners

Most law firms have made their partner promotions for 2009, and the results are a "mixed bag" for women, according to the Project for Attorney Retention. A study of new partner classes at 85 major law firms found that women made up about 28% of newly minted partners. The results varied greatly from firm to firm, however. Women made up 40% or more of new partners at 23 of the firms surveyed, while 14 firms did not promote any women to partner this year.
