During discovery, Price's team found a stack of documents that it believed showed clear evidence of infringement. The team began putting on witnesses from BCGI and other defendant companies to get them to respond to the documents. The unusual strategy paid off with a $128 million verdict.

The plaintiff was Function Media, a patent holding company owned by husband-and-wife inventors Michael Dean and Lucinda Stone.
