Defense Must Produce Tape, Then Depose

Video surveillance tapes cannot be used at deposition to contradict a plaintiff unless the defendant shows the plaintiff's testimony was inadequate to cover the issues raised by the tapes. The ruling from a New York Supreme Court justice means that the defense in a medical malpractice case cannot schedule a new depostion for the plaintiff without turning over the tapes.
