The family of a Long Island Railroad employee who claimed he contracted a fatal illness from inhaling asbestos dust on the job cannot seek compensation in state court, Manhattan Supreme Court Justice Helen E. Freedman has ruled. Freedman granted summary judgment for American Standard and its Westinghouse Air Brake division, finding that the state common-law claims were pre-empted by federal law. The family's attorney said the federal laws are not being used as intended, to give manufacturers immunity.
