In an en banc decision, the 5th Circuit has overturned its own 21-year-old precedent, ruling that under the federal criminal forfeiture statute, no notice is required before a court issues an ex parte restraining order freezing the assets of a party facing federal prosecution. The 5th Circuit ruling will prevent a group of plaintiffs from collecting a $116 million default judgment against a charity with alleged ties to Hamas, until the federal prosecution of the charity concludes.
