Foley & Lardner Sued Over Missed Biotech Patent Filing
A fledgling biotech company is suing Foley & Lardner for allegedly missing the filing date on an international patent application. Vaxiion Therapeutics, which develops new ways to deliver vaccines using genetically engineered mini-cells, claims Foley attorneys missed the deadline by four days, allowing a competitor to cash in on the same intellectual property, according to a complaint filed in San Diego County Superior Court. The kicker is that Foley allegedly represented the competitor at the same time.Lawyers Stump for End to Tough Patent Policy
Patent lawyers have long chafed under rules that require them to relinquish attorney-client privilege in certain patent cases. But that may change. The Federal Circuit recently announced it was reviewing the issue and asked for public comment. Lawyers flooded the court with amicus briefs pleading for repeal of the rules.
