Pa. Jury Awards $3M to Ohio Couple in Prempro Case

In the retrial of a case in which an Ohio woman claimed she was harmed by using the Wyeth hormone replacement drug Prempro, a Philadelphia jury awarded $2.4 million to the woman and $600,000 to her husband. In the first trial, a mistrial was declared before liability was determined. It was the second completed Prempro trial in which a Philadelphia jury ruled against Wyeth."The scorecard is plaintiffs 2, Wyeth 0," said the Ohio couple's lawyer. An attorney for Wyeth says the company will appeal.

Overturned $3M Verdict Explained in Hormone Replacement Therapy Opinion

A woman who sued Wyeth, claiming her breast cancer was caused by the company's hormone replacement drug, did not show sufficient evidence that her doctor wouldn't have prescribed the drug if warnings were better, a Philadelphia judge explained as to why he overturned a $3 million jury award. Attorneys for Wyeth say the opinion could have a significant effect on the 1,500 similar cases pending in Philadelphia.

Tyco International said Tuesday it has agreed to pay about $3 billion to settle shareholder claims that arose after former CEO Dennis Kozlowski and other top officers were charged with looting the company and inflating its value. Investors were given the green light last summer to proceed with a consolidated class action lawsuit in federal court. Lawyers for the shareholders said it was the largest settlement ever by a single corporate defendant in a class action suit.
