Napster Faces the Music

For music-swapping Web site Napster, it may be the day the music died. With a few key exceptions, the 9th U.S. Circuit Court of Appeals on Monday backed a lower court's injunction against Napster, agreeing that the company is likely to be found liable for contributory and vicarious copyright infringement. Napster lawyers plan to appeal, including a request for an en banc hearing before the 9th Circuit.

It's Alive

Napster Downloads a Reprieve

With a techie on the two-judge panel and a reputation for tackling high-profile technology cases, it's not surprising that the 9th U.S. Circuit Court of Appeals decided Friday it wanted a piece of the Napster action. But they were also disdainful of the lawyer who won the case, indicating he had entered into a fee-splitting agreement with a BofA insider that violated ethical rules.
