Rakoff Assigned to Lawyer's Case

Southern District Judge Jed S. Rakoff, an independent-minded veteran of the federal court, has been assigned the case of attorney Marc S. Dreier, who was indicted Thursday on charges he had defrauded hedge funds and investors of $400 million. Mr. Dreier could spend the rest of his life in jail if convicted of the charges: conspiracy to commit securities and wire fraud as well as securities fraud and wire fraud. The charges represent an expansion of the counts with which Mr. Dreier was charged after his Dec. 7 arrest in New York.

ALBANY In a ruling that potentially shifts the balance of power in a significant sector of the New York City housing market, the Court of Appeals yesterday held that cooperatives, condominiums and their shareholders can sue sponsors who fail to sell apartments within a reasonable period following conversion. The decision recognizes a cause of action for breach of contract, and could spark a spate of lawsuits by tenant-owners and co-op boards when sponsors are hoarding unsold apartments.
