Back to Miranda

When he emerged from the appellate court arguments on the suppression of his client's statements in connection with a bank robbery, James W. Hundley felt his stomach churn. "I thought, I'm going to be the attorney who gets Miranda reversed." He may have been right. Hundley is preparing to defend the rule in front of the Supreme Court on April 19. Fate catapulted Hundley and his client into a precedent-shattering position. It's exactly the same phenomenon that made Miranda a household name.

Court Sharply Divides on Prison Law

Taking up a case that challenged a law enacted in 1995, the Ninth Circuit U.S. Court of Appeals reached the curious conclusion that the issue was decided 26 years ago. But even so, the majority of an en banc court took a shot at Congress for meddling in judicial oversight of prison litigation. On Friday, a sharply divided Ninth Circuit issued a ruling that rendered moot a case challenging the 1995 Prison Litigation Reform Act, which sought to limit civil rights cases brought by prisoners and advocates.

'NLJ 250' Shows Strong Law Firm Growth Continuing

The 250 largest law firms in the U.S. grew by 4 percent in 2006, a figure that was just shy of the prior year's gains, according to The National Law Journal's 29th annual survey. The results indicate a "healthy legal economy" spurred by strong mergers and acquisitions activity and big-ticket litigation, said one law firm consultant. And while law firms used to base their mergers on geography and size for size's sake, they now take a much more strategic approach, said another consultant.
