Bankruptcy Court Decides When Trade Vendor Priority Claims Get Paid

The U.S. Bankruptcy Court for the Eastern District of Pennsylvania recently issued one of the first decisions in the 3rd Circuit interpreting new Bankruptcy Code �503(b)(9), which entitles vendors who deliver goods within 20 days of a petition to an administrative priority claim. The code requires payment of administrative claims before confirmation of a reorganization plan but doesn't otherwise specify timing of �503(b)(9) payments. The bankruptcy court held that courts have discretion to decide timing.
