The city of Philadelphia isn't immune under Pa. law from a class action's gross negligence claim, an attorney has argued before the state Supreme Court, in an attempt to revive a $3.76 million judgment for 12,000 city employees who allege mismanagement of their deferred compensation plan. In 2006, the Commonwealth Court reversed a trial court finding that the city had breached the terms of the city employee pretax savings plan. At issue is whether the gross negligence allegation is a tort or contract claim.
