Bone and Marrow Transplant Suits' Docket: 500 and Still Climbing

In the short time -- a little over a year -- since New Jersey's federal district became the epicenter for multidistrict litigation over bone and tissue transplants from pilfered cadavers, the cases have grown from five to more than 500, with no end in sight. The plaintiffs are mostly transplant recipients, but do include some donors' relatives, who are suing Biomedical Tissue Service, the company that allegedly harvested the transplant products and several distributors that bought the products.

Bone Screw Makers Protected Against Surgeon's Lawsuit

An orthopedic surgeon who claims he was hit with a slew of lawsuits for using pedicle bone screws in spinal fusion operations can't sue the devices' manufacturers because he wasn't the direct purchaser, the 3rd U.S. Circuit Court of Appeals has ruled. The court rejected the doctor's theory that he should be allowed to sue under Pennsylvania's Consumer Protection Law as the "purchasing agent" for his patients.
