Philadelphia Antitrust Case Remanded to Lower Court
A price-fixing case filed in Pennsylvania state court that asserts no federal claims, cannot be removed to federal court since antitrust is not an area of complete federal preemption, a federal judge ruled. The judge found that Pennsylvania state courts are the proper forum for the case -- even though Pennsylvania has no antitrust statute. "Pennsylvania courts have recognized the unlawfulness, in a civil context, of price fixing conspiracies and other combinations in restraint of trade," the judge wrote.Martindale-Hubbell Faces Challenges
