2nd Circuit: Immunity Shields Officers Who Ignored Fatal Binge

Police officers who allegedly ignored, or aided and abetted, the 12-hour drinking binge of a fellow officer who killed four people in a drunken-driving accident are shielded from a substantive due process claim, the 2nd Circuit has ruled. Rejecting family members' right to sue for a violation of their right to be free from a "state created danger," the court said the law at the time of the accident was not so clearly established that the officers could be considered aware of their potential liability.

Bias Suit on Police Frisks Revived

A complaint alleging racial profiling by an elite unit of the New York Police Department was revived by a federal judge reconsidering a decision to dismiss the action. District Judge Shira A. Scheindlin reinstated the cause of action seeking damages for unlawful targeting of black and Latino men to be stopped and frisked. The court abandoned its earlier position that the lawsuit should fail for lack of evidence that non-minority individuals were not stopped and frisked.

In a victory for hedge funds holding debt of the Republic of Argentina, the U.S. Court of Appeals for the Second Circuit refused to narrow injunctions intended to pressure the South American country to repay the funds.
