Gunster Yoakley Faces $170M Malpractice Suit

A long-threatened blow fell Thursday on Florida-based Gunster, Yoakley & Stewart and one of its shareholders, as bankrupt factoring firm E.S. Bankest L.C. filed a legal malpractice suit against the law firm. The suit contends the defendants breached their fiduciary duties and seeks compensatory damages of $170 million. Gunster's president, Donald Beuttenmuller Jr., denied any wrongdoing, adding, "The corporation and people who ran it lied to us as they did to their accountants."

Gunster Yoakley & Stewart faces two legal malpractice trials in which plaintiffs are accusing the Florida-based law firm and its attorneys of conflict of interest and are seeking tens of millions of dollars in damages. Both suits -- one involving heirs to the Gannett newspaper fortune -- claim that Gunster lawyers failed to properly notify a client that the firm represented one or more other parties with whom the client did business. Some experts say a loss could force the law firm into bankruptcy.
