Pedestrian Hit by Car in Parking Lot, Broke Wrist
On Oct. 3, 2017, plaintiff Denise Cimino, 55, a part-time bookkeeper, was struck by a reversing vehicle. The incident occurred in a parking lot in Southampton. She suffered an injury of a wrist. The Pennsylvania Supreme Court, citing its landmark decision in 'Gallagher v. Geico,' had previously vacated and remanded a Superior Court ruling affirming the denial of underinsured motorist coverage for a plaintiff who was injured when his motorcycle collided with a car. But now the justices have refused to hear a second appeal after the Superior Court found that 'Gallagher' had no bearing on the case.
