Proposed Texas Disciplinary Rule Changes Target Conflicts, Scienter, Sex

For the first time in almost 20 years, the Texas Supreme Court has proposed comprehensive changes in the state's disciplinary rules for lawyers, including major amendments to conflicts rules and a new rule prohibiting lawyers from having sex with clients. On Oct. 20, a unanimous Supreme Court began the process for public comment and ultimately -- if the State Bar of Texas board of directors agrees -- a referendum on the proposed amendments to the Texas Disciplinary Rules of Professional Conduct.

Déjà Vu All Over Again: State Bar to Reconsider Insurance Disclosure

Should Texas lawyers have to disclose whether they carry professional liability insurance? In September, the State Bar of Texas announced that it will gather input on a possible disclosure requirement. The Bar's Web site now indicates the State Bar board of directors will vote at its January 2010 meeting on a recommendation to the Texas Supreme Court on whether a disclosure rule should be adopted and, if so, the preferred method of disclosure.

Texas Bar Considers Insurance Disclosure Rule for Lawyers

The State Bar of Texas last week concluded a series of seven public hearings focusing on whether lawyers should have to disclose if they have professional-liability insurance. A majority of the 67 speakers who testified at the hearings were of a like mind: They oppose such a rule. According to the American Bar Association, Oregon is the only state where professional-liability insurance is mandatory for lawyers, and there are 25 other states with rules requiring lawyers to disclose whether or not they have such coverage.
