Judge Says Right to Farm Act Unconstitutional

The ruling in Texas Beef Group v. David W. Bergin, et al. came down 12 years after Amarillo's Texas Beef Group filed the declaratory judgment action seeking to stop a suit filed by a family of landowners against the company. The Bergin family complained in a nuisance suit that the company expanded its Palo Duro Feedyard while failing to control air pollution problems, which created health problems on the family's land.
