Texas Court Rejects 'Deepening Insolvency' Tort Theory

In a case of first impression, disgruntled creditors of an insolvent company can't use the theory of "deepening insolvency" to hold the company's lenders responsible for its demise, a federal bankruptcy judge in Texas ruled recently. The idea behind the theory is that a defendant's conduct fraudulently prolonged a company's life beyond insolvency, resulting in damage to the company because of increasing debt. Contrary to the recent Texas court, some federal courts have recognized the tort theory.
