Toyota has agreed to pay more than $1 billion to settle multi-district litigation over financial losses associated with acceleration problems reported in some Toyota and Lexus vehicles. The Japanese car maker and plaintiffs lawyers filed a copy of their proposed settlement Wednesday in federal court in Orange County, California.
Class action plaintiffs lawyers may be tallying up the settlements they've won in the sprawling San Francisco antitrust litigation over flat panel liquid crystal displays, but the fight is still in full swing for the many LCD purchasers, like Dell Inc., that opted out of the class to pursue their own price-fixing claims.
Mirant Aims to Fend Off Worker Suits Over 401(k)s
Bankrupt Mirant Corp. has filed a motion to dismiss a potential class action brought by employees and retirees over their 401(k) plans. Mirant's attorneys argue that the company's retirement plans weren't intended to maximize returns on employee investments but were, instead, designed to bolster stock sales and that regulations exempt fund managers "from any responsibility to diversify company assets that are invested in company stock."In a potentially ruinous suit for the gift card industry, a company called Every Penny Counts claimed that all gift cards violated its patents on technology for transferring "excess cash." The Federal Circuit thought differently.
Trademark Lawsuits: The Price of Online Griping
The Internet serves as a haven of outcry for disgruntled customers who create "gripe sites" aimed at their company of choice. The companies have cried foul, and are calling their antagonists to court for trademark infringement. Critics of the lawsuits, like Paul Levy of the Public Citizen Litigation Group, say they're being used to "suppress perfectly legitimate, noncommercial speech."Tenet Healthcare fended off a $4 billion hostile takeover bid last year in part by accusing Community Health Systems, its would-be acquirer, of bilking Medicare out of hundreds of millions of dollars. Almost exactly a year later, Tenet's lawyers at Latham & Watkins and Arnold & Porter have helped the company resolve nearly identical claims leveled by the Justice Department.
