Tobacco Companies Win Dismissal of Foreign Tax Suits

A federal judge in New York ruled Tuesday that the common-law principle that federal courts will not enforce foreign tax judgments wasn't subverted when Congress toughened money laundering provisions with passage of the Patriot Act in October 2001. The judge dismissed three suits brought by countries that charged major U.S. tobacco companies were undermining tax collections by encouraging cigarette smuggling.

A lawsuit charging Royal Dutch Petroleum Company, parent company of Shell Nigeria, aided and abetted the murder of Nigerian activists who opposed oil drilling on their lands will be heard in New York federal court following a ruling Thursday by the 2nd U.S. Circuit Court of Appeals. A unanimous panel reversed the finding of a lower court judge who dismissed the case on forum non conveniens grounds.
