A federal judge in New York improperly ruled in favor of former IBM executive Edward W. Lucente in his fight over millions of dollars in stock options, the 2nd U.S. Circuit Court of Appeals has ruled. The 3rd Circuit has given Merck shareholders a second chance to seek to use after-acquired information in derivative suits alleging officer and directors concealed painkiller Vioxx's health risks. The court ruled that U.S. District Judge Stanley Chesler erred by refusing to consider new information, which resulted from a consensual stipulation, in dismissing the suit. But the 3rd Circuit agreed with Chesler's ruling that the plaintiffs were subject to a heightened factual pleading standard.
