Rejecting the reasoning of two decisions by the Pennsylvania Superior Court, the 3rd Circuit has ruled that arbitration agreements cannot be deemed "unconscionable" solely on the grounds that they require consumers to waive their right to pursue class action claims. The 3rd Circuit found that use of class action waivers in arbitration agreements are not prohibited by the federal Credit Repair Organizations Act or Pennsylvania's Credit Services Act.
