The Supreme Court ruling barring securities claims by foreign investors is quickly reshaping the securities class action landscape. In the latest application of Morrison v. NAB, foreign investors in a Bahamian fund can't proceed with claims that several non-U.S. banks should have detected Bernie Madoff's Ponzi scheme.
Kasowitz, Benson, Torres & Friedman won a TRO on behalf of the magazine publisher and distributor Source Interlink, which accuses its rivals of a conspiracy to run it out of business by, among other things, cutting off its supply of magazines. The order requires major magazine publishers and disrtibutors to supply Source with their titles, like People, Sports Illustrated, and Time, on the same terms before they cut Source off in February.
Vivendi's challenge to the class action verdict focused on its inconsistency: Jurors exonerated two Vivendi top officials who allegedly made misleading statements about the company's liquidity crisis, yet found Vivendi liable for the statements. Too bad, the plaintiffs argue in their response. Vivendi waived the right to make that argument in negotiating jury instructions.
It's been a tough slog through the courts for a group of pharmacy plaintiffs with antitrust claims against some of the biggest drug companies in the land. Plaintiffs lawyer Joseph Alioto stuck with the case for nearly a decade, including through two trips to the California Supreme Court. Now he's finally run out of appeals.
