Deferred Prosecution Deal Raises Objections

Thanks to a deal arranged with the feds last year, auditing giant KPMG has been able to avoid a likely criminal indictment. But now, motions by 19 indicted tax and estate professionals, most formerly with KPMG, accuse the government of stacking the deck. A defense attorney not involved in the case says the events show the lack of standards for such agreements, adding, "It's whatever prosecutors can get away with, and that's a lot, because companies trying to save themselves are willing to do anything."

Judge Censured for Ordering Lawyers to Be Paid by Retailer Gift Vouchers

California's Commission on Judicial Performance on Tuesday publicly censured Judge Brett Klein, who stepped down from the bench on Dec. 1, barring the 20-year veteran from future judicial assignments. The CJP dinged Klein for his handling of a class action against a clothing store chain and found that Klein had abused his authority when he altered the final approval order to make a $2,500 award to the lead plaintiff and $125,000 in fees to a plaintiffs lawyer payable in $10 gift vouchers from the retailer.

The American Lawyer's interviews with more than two dozen attorneys show that although the war has been largely unfelt in Am Law 200 offices, it is intensely personal for those who have worked or served in the war zone. Judge Tossed Out for Delay, Neglect

The California Commission on Judicial Performance has ordered Riverside County Superior Court Judge Robert Spitzer removed from the bench, finding that he engaged in a pattern of misconduct involving "inexcusable delays, failure to act and gross neglect of court orders." The commissioners said that Spitzer's court and chambers were routinely "in shambles" and that files were often lost or misplaced. But the Superior Court's presiding judge called Spitzer "one of the hardest-working judges I've ever met."
