Sills Cummis Name Partner's Plaintiffs Cases Prompt His Exit

Barry Epstein has quit Newark, N.J.'s Sills Cummis Epstein & Gross after 31 years. Epstein and Robert Max Crane, the deputy managing partner at what is now Sills Cummis & Gross, say Epstein's prosecution of class action claims in the health-care field exposed the firm to potential conflicts and was not in sync with the business plan. Epstein's relocation to the more plaintiff-oriented Wilentz, Goldman & Spitzer is a rare instance of a name partner at one large New Jersey firm becoming a partner at another.

A plaintiff whose $1.3 million asbestos claim was no-caused by a New Jersey jury has asked for a new trial because a juror confessed he switched his vote at the end of the 10-hour deliberation, saying that otherwise, "we would've never gotten out of there." The e-mail, sent to plaintiffs lawyers six days after the verdict, included expressions of sympathy and sorrow and barbs against other members of the jury panel, though it's hard to glean from the message exactly what did happen.
