Taxing of Telecommuters to Go Before New York State's High Court
The Court of Appeals will hear a case Wednesday that focuses on the question: To whom does a telecommuter pay state income tax? Although Thomas Huckaby of Tennessee does not live in New York, does virtually no work there and spends little time there, New York claims it's entitled to tax 100 percent of his income because his employer is based there. The case is being closely watched by other states striving to reconcile old tax codes with contemporary work habits.Chip Maker Grabs Oregon Company for $584M in Stock

When a DEA officer contradicted himself over the reliability of an informant in U.S. District Judge Charles Breyer's courtroom, Breyer demanded to know who would be responsible for investigating. Public defender Barry Portman said that while he hopes the investigation will help defendants who face charges -- thanks to questionable snitches -- he's skeptical it will have much of an effect. That's because of a 2002 U.S. Supreme Court decision authored by Breyer's older brother, Justice Stephen Breyer. The Globalization of Investigations
For clients whose primary presence is in the United States, including e-commerce businesses, cross-border cooperation among law-enforcement organizations raises distinct and difficult issues. An effective defense requires knowledge of treaties and criminal law in two or more jurisdictions and collaboration among defense counsel in different countries.Name Partner Schulman Exits Milberg Weiss
Steven Schulman, a name partner at Milberg Weiss Bershad & Schulman, resigned from the embattled class action firm Friday, seven months after he and another partner were indicted in an alleged kickback scheme. Lawyers familiar with the case said the timing of his departure was designed to maximize his payout on leaving the partnership. Schulman's spokesman said the resignation will have no impact on Schulman's joint defense with the firm, but some say Schulman is not averse to negotiating with prosecutors.Employment Bias Suits Made Easier
A unanimous decision earlier by the U.S. Supreme Court could make proving employment discrimination cases easier, lawyers on both sides of the suits agree. Plaintiffs' employment lawyers are thrilled with the decision, while management-side lawyers, though more circumspect, reluctantly agree that the ruling lowered the ante for plaintiffs.Subprime Crash May Be a Boon to Attorneys
As subprime lenders get ready to confront a host of legal and financial challenges in the coming months, attorneys are preparing for growing workloads. Outside attorneys will be needed to help companies with corporate restructurings, asset sales and bankruptcy filings; guide them through state and federal government probes; and take on class actions by consumers, investors and employees. "We're seeing this hit across multiple practice areas," says Neal, Gerber & Eisenberg's Jerry Biederman.Trending Stories
