Screenwriters who have sued Fox Entertainment and others, claiming that the 2004 comedy "Dodgeball: A True Underdog Story" copied their original screenplay have dodged an attempt by Fox to have their lawsuit dismissed. A Southern District of New York judge held that the plaintiffs' and defendants' screenplays were similar enough to allow the case to proceed. The 2nd U.S. Circuit Court of Appeals has upheld a jury verdict finding that the U.S. Polo Association did not infringe on a Ralph Lauren trademark. The appeals court also found that New York federal Judge George Daniels properly excluded from evidence the so-called "Ralph Rip-Off" document, which purported to show intent to use the Lauren mark unfairly.
