Health Fund Suits Against Tobacco Giants Rejected

A 2nd U.S. Circuit Court of Appeals panel ruled Friday that two New York union health funds and four public employees' health plans can't proceed with class action suits against major tobacco companies. The panel said in Laborers Local 17 Health and Benefit Fund v. Philip Morris Inc. that the economic damages allegedly suffered by the plaintiffs were too remote to be actionable. Last month, the 3rd Circuit upheld the dismissal of a similar labor fund class action in Pennsylvania.

IBM-Lenovo Merger Under Scrutiny

IBM Corp. and China's Lenovo Group Ltd. are negotiating with federal regulators to assuage any national security concerns over their $1.7 billion deal, sources said. The Committee on Foreign Investments in the U.S., a multiagency panel that reviews acquisitions of U.S. businesses by foreign companies, is expected to decide by Friday whether to launch a formal investigation into the deal, under which Lenovo would acquire IBM's PC manufacturing business.

MasterCard Wins Battle Against Visa Concerning Service Fees

Attorneys at Simpson Thacher & Bartlett have won a huge, three-year-long battle for MasterCard and against Visa. MasterCard was challenging a Visa bylaw that forced its largest debit card issuers to pay a large penalty for switching their business to a competitor. U.S. District Judge Barbara Jones of the Southern District of New York ruled that a service fee Visa places on its debit card issuers basically deters them from taking their business to a competitor, making it illegal.
