Coercive Jury Instructions Lead to Drug Conviction Upset
A judge who told a deadlocked jury its job was "to get a result" coerced it into returning a guilty verdict five minutes later, New York's Court of Appeals has ruled. The Appellate Division, 1st Department, had earlier reversed the conviction in a 3-2 decision identifying five errors in the trial judge's charge. The Court of Appeals agreed with the 1st Department majority, and admonished trial judges to strike an appropriate balance in jury instructions.Five from VLG Leave Heller, Opt for Orrick
