NJ Court Upholds New Injury Treatment Rules

The Appellate Division upheld the state's new regulations on treatment for certain soft-tissue injuries caused by auto accidents, delivering a severe blow to opponents of the insurance industry-backed rules. However, the three-judge panel did toss the appellants a bone last Monday, ruling that the "loser pays" provision was invalid. That measure would have required accident victims who lose in an arbitration over a disputed claim to pay the insurer's legal fees.
